Last night Norfolk police arrested Derek McGillivray for terroristic threats at a Burger King in Norfolk.

Just after 8 p.m. Norfolk police got a call that 20 minutes prior Derek McGillivray came into the restaurant  ordered some food and then ask the employee to come talk with him at the other end of the counter. He showed the employee a gun that was placed inside of a Burger King crown.

McGillivray said he was initially going to rob the restaurant but he had since changed his mind.

After the witness told McGillivray that there was no place for guns there, he put the weapon back in his waist band and left the establishment.

Police charged the 21-year-old for making terroristic threats, use of a weapon to commit a felony, carrying a concealed weapon, and disturbing the peace.

McGillivray was taken to the Norfolk City Jail and then transferred to the Madison County Jail.
